TERMS AND CONDITIONS of SALE

1. Payment
All payments to iShopMarine.com must be made in US dollars.

1-a. Credit Cards
iShopMarine.com accepts MasterCard, Visa, Discover Card and American Express credit cards. All payment information must be accurately provided. We require Card Holder Name, Credit Card Number, Expiration Date and Validation Code. The 'Billing Address' indicated on the order must match the address recorded by the credit card provider.

1-b. Money Orders
iShopMarine.com provides customers with the additional convenience of making payments via money order. Money orders are accepted from recognized issuing authorities such as the US Postal Service, Western Union and major banks. Orders submitted subject to the money order payment option are conditionally accepted pending the actual receipt of a corresponding money order. Money order payments must be for the exact order amount.

1-c. Order Processing with Money Order Payments
To facilitate order processing for orders submitted with the money order payment option, iShopMarine.com provides the customer with an option to submit money order identification information either when the order is submitted or at a later time. iShopMarine.com will begin processing the customer's order upon submission of the money order information. This permits the order to be shipped promptly upon receipt of the actual payment.

Orders submitted with the money order payment option will be automatically canceled if the money order or the payment information is not received within seven (7) days of placing the order.

2. Pricing
iShopMarine.com is proud to offer customers discounted pricing on quality products.

Listed prices and quotations are based on current supplier price lists and are subject to change without notice. Changes in commodity markets or administrative errors in the posting of product pricing may result in unannounced price changes. Prices posted or quoted in error are subject to correction. Quotations are valid for 30 days unless otherwise specified.

2-a. Unit Prices
All prices indicated at iShopMarine.com are 'Unit' prices. Some items are available in 'Package' quantities. Additional item discounts are typically provided for items when ordered in exact multiples of the 'Package' quantity. However, the requested order quantity is always the 'Unit' quantity and not the 'Package' quantity. For most package items, iShopMarine.com makes unit quantities available to customers as a practical convenience although some items may only be sold in 'Package' quantities.

All prices displayed at iShopMarine.com are individual 'Unit' prices. Some items may only be sold in 'Package' quantities.

ie: Description of item appearing at iShopMarine.com: Gasket (5 pack). Indicated pricing represents the price for 1 individual unit and not the price for a package quantity of 5. If a quantity of 2 is indicated by the customer, customer will receive 2 individual gaskets and not 2 packages of 5 gaskets each. Online item information will indicate both the unit price for quantities that are less than or not equal to exact multiples of the package quantity and the unit price for quantities that are exactly equal to multiples of the package quantity.

3. Product Identification and Information
iShopMarine.com utilizes it 'Best Efforts' to provide accurate descriptions and an easy to use format that allows customers to identify specific product requirements for their particular application(s).

3-a. Product Identification
iShopMarine.com is a 'Self-Service' Web site. Customers utilizing the formats, images and descriptions provided by iShopMarine.com accept the responsibility for accurately identifying their specific product requirement. iShopMarine.com is not responsible for any incorrect identification of specific product requirements by customers.

Merchandise returns for products that are incorrectly identified by customers are governed by these 'Terms and Conditions of Sale' and the associated 'Merchandise Return Policy'.

3-b. Information Accuracy
Information displayed at iShopMarine.com has been checked carefully for accuracy. However, due to continuing updates, improvements and changes in product lines, errors in photography, descriptions or pricing may occasionally occur and are subject to correction.

4. Order Processing
iShopMarine.com does not typically provide 'Same-Day-Shipping' service. iShopMarine.com provides our customers with a selection of over 400,000 active items. Many items are available in stock while most are procured on demand from our extensive supplier network. Not all items are immediately available.

iShopMarine.com consolidates non-stock order items from numerous warehouse facilities across the United States. Order preparation time usually depends on the stocking location of the specific item(s) requested.

4-a. Typical Order Preparation Times
iShopMarine.com typically ships 20% of new orders within twenty-four (24) hours, 60% of orders are shipped within seventy-two (72) hours and 95% of new orders are shipped within five (5) working days. Unexpected manufacturer 'Backorders', Items only available by 'Special Order' or items classified as 'Vintage Part' may take significantly longer.

4-b. Backorders
iShopMarine.com automatically 'backorders' any part that is not immediately available. Our customer service department will employ its best efforts to track and expedite backordered items. The status of a backordered item(s) is available by reviewing the order online. Backordered items will remain 'Open' for up to 180 days unless canceled by the customer or the supplier. Cancelations must be in writing either via 'order support' email or by phone with an email acknowledgment from iShopMarine.com.

'Special Order' items and items designated as 'Vintage Parts' although not immediately available are order items 'In Process' and are not considered backorders. Special terms apply to these items and cancelations may incur significant restocking charges as indicated in iShopMarine.com's published 'Returns Policy'.

4-c. Substitutions
iShopMarine.com often provides customers with a choice of items for a specific product application. These alternative items are usually represented for a particular application by different suppliers or manufacturers. In the event that a customer selects an item that is temporarily out-of-stock or otherwise unavailable, iShopMarine.com reserves the right to facilitate the processing of the customer?s order by supplying the customer with an alternative item of similar value for the same product application.

Under the following circumstances, substitutions will be processed without notification to the customer:

  • Original equipment manufacturer (OEM) items may be substituted for aftermarket (AM) items
  • Items of known quality from one supplier may be substituted for items of equal or better quality from another supplier
  • The substituted item value does not exceed the value of the originally requested item by more than 20%
  • The customer has not specifically indicated 'No Substitutions' for requested items when the order was submitted.

In the event of an item substitution, the item price will be the published price of the substituted item and not the price of the originally requested item.

Merchandise returns for products substituted within these established guidelines are governed by these 'Terms and Conditions of Sale' and the associated 'Merchandise Return Policy'.

Occassionally, item substitutions occur outside of the above indicated guidelines. This can happen if the item requested is not currently available or if we are not able to contact the customer in a timely manner to request the approval of an 'Out-of-Guideline' substitution. An 'Out-of-Guideline' substitution may be returned to iShopMarine.com for full-credit.

4-d. Partial Shipment of Orders
iShopMarine.com provides customers with a large selection of available products for recreational marine motors spaning over 50 years of manufacturing. Order fulfillment is one of our most important customer service considerations.

Many requested items may not be immediately available and/or require special procurement arrangements with our network of suppliers. If the customer specifies 'Ship Complete' with the submission of their order, iShopMarine.com will use it's best efforts to assemble the complete order for shipment. However, iShopMarine.com does not guarantee a complete shipment of the requested items.

iShopMarine.com does not guarantee a complete shipment of all the items requested on an order.

iShopMarine.com does not typically 'hold' orders in process waiting for items requiring additional procurement time and reserves the right to partially ship customer orders pending the receipt of longer lead-time items. Items will be billed to the customer only when actually shipped.

Depending on the availability of requested items, iShopMarine.com reserves the right to partially ship customer orders.

Additional nominal delivery service charges may be applied to subsequent product shipments for the same order.

Partial shipment of orders may incur additional delivery service charges.

4-e. Order Life
iShopMarine.com typically keeps a customer's order or order line item open for up to 90 days without notification to the customer. Customers will be notified regarding specific supplier backorders. Known backorders for which notifications have been provided to the customer may be maintained as open for up to 180 days.

4-f. Delivery of All Requested Items is Not Guaranteed
iShopMarine.com uses it best efforts to procure all requested items for customer orders. Our on-hand inventory and extensive supplier network routinely supply customers with a choice of over 400,000 products. Occassionally some items represented for sale may not be currently available or have been permanently discontinued by the associated manufacturer or distributor. In these instances, unavailable items will be canceled from customer orders. Since iShopMarine.com only bills customers for items actually shipped, canceled items are never charged to the customer and therefore do not require a refund.

4-g. Customer Requested Shipment or Delivery Deadlines
iShopMarine.com employes it 'best efforts' to fulfill customer orders in a timely manner. Where possible iShopMarine.com will attempt to facilitate order processing to satisfy the expressed delivery requirement of the customer.

However, the request by the customer of a delivery deadline during or subsequent to the submission of an order in no way obligates iShopMarine.com to adherence to the imposed deadline. Failure of iShopMarine.com to meet the customer's requested delivery deadline is in no way a breach of the order contract between the customer and iShopMarine.com. All of these 'Terms and Conditions of Sale' will remain in effect and supersede customer requests in the event of a conflict.

5. Delivery Service
Delivery services are provided by UPS, US Postal Service, FedEx, UPS Freight or LTL truck depending on destination, package size and weight. In most instances, customers may select the delivery service of their choice.

5-a. Delivery Service Expectation
The carrier delivery service that is requested when placing an order at iShopMarine.com represents the delivery service from the date that the order is prepared for shipment and NOT from the date that the order is submitted. iShopMarine.com will typically expedite order processing for orders requesting expedited delivery services.

i.e.: Requesting 'Next Day Air' delivery service with the submission of an order does not necessarily result in receiving the order the next business day. It means that the order will be received on the next business day subsequent to when the order is available for shipment.

5-b. Delivery Service Charge Estimates
iShopMarine.com provides online estimates of the cost of various delivery services to assist customers with the selection. While we apply our 'Best Efforts' in determining these estimates, occasionally the nature of the item requested or the availability of relevant information regarding the shipment of the item renders the estimate inaccurate. Often iShopMarine.com does not have accurate information from suppliers regarding the size and weight of specific items. Customers should apply good judgment in selecting a specific delivery service and request assistance from iShopMarine.com when in doubt.

i.e.: An exhaust manifold weighing 40 pounds cannot be shipped across the country for $9.95.

While every effort is made to provide accurate estimates of shipping charges at the time an order is placed, iShopMarine.com reserves the right to bill all shipping charges to the customer as actually incurred at the time of shipment plus a nominal processing charge.

5-c. Changes to Customer Requested Delivery Services
iShopMarine.com will usually ship a customer's order via the carrier and delivery service selected by the customer upon submission of their order. Occasionally, iShopMarine.com will ship a customer's order via a different carrier or delivery service than the one selected by the customer. Changing the customer's selected carrier or delivery service may occur under the following circumstances:

Delivery service time is the same but a lower cost to the customer is realized - This often occurs when the customer has selected an expedited delivery service not realizing that a lower cost service will achieve the same delivery time.

Delivery time is reduced for the same or a lower cost - Delivery services offered vary by carrier. Some carriers accept Saturday shipping of packages and/or Saturday delivery without surcharges. In certain instances, this may facilitate delivery to the customer.

Availability of an alternative carrier - Carriers have different pickup or drop-off times when providing services to iShopMarine.com. Sometimes an order may be ready for shipment after the cut-off time for the requested carrier but may still qualify for immediate shipping via an alternative carrier.

Shipment of a residual order balance - For orders that are initially 'shipped partial', additional shipment charges may be reduced by utilizing an alternative carrier. Often residual order balances for packages with a weight of 2 pounds or less will be better served by an alternative carrier reducing delivery service charges while providing comparable delivery times.

Discrepancy in estimated shipping charges - Occasionally the delivery service charge estimated at the time of the submisison of an order will be less than the actual delivery service charge indicated by the carrier. This may be the result of incorrect item weights or package dimensions applied as the bases of the estimate provided. In these instances, iShopMarine.com may change the customer's selected delivery service or carrier to better approximate the estimated charge.

iShopMarine.com will at it's discretion change the customer's requested delivery service or carrier according to the guidelines presented above. If a customer desires that only the selected delivery service carrier be utilized, the cusomer can indicate 'Selected Carrier Only' upon submission of the order. With this designation, all delivery service charges will be based on the actual charges indicated by the selected carrier.

5-d. Carrier Changes in Delivery Service Charges
Delivery service carriers periodically change published prices and/or associated surcharges. iShopMarine.com will charge delivery services based on the published prices of the selected delivery service carrier that are in effect on the date and time of order shipment.

5-e. Order Processing and Handling Charge
iShopMarine.com adds a discretionary 'Handling Charge' to most orders. The 'Handling Charge' covers costs related to processing and packaging the order for shipment. The 'Handling Charge' is included in the delivery service estimate. Orders that have an item subtotal of less than $25.00 incur an additional surcharge which is also included in the delivery service estimate.

5-f. Delivery Service for Orders with 'Special Order' Items or 'Vintage Parts'
Due to the procurement lead times that are often associated with 'Special Order' Items or 'Vintage Parts', orders with these types of items will often be 'Shipped Partial' and may incur additiional delivery service charges.

5-g. Delays in Delivery Service
iShopMarine.com is not responsible for delivery service delays caused by factors beyond its control such as carrier errors and unexpected carrier delays.

5-h. Restricted Delivery Service Items
Some items sold by iShopMarine.com are restricted to 'Ground' delivery services. These items include aerosols, lubricants, paints and oil based products among others. Restricted products considered hazardous for shipping may require special packaging and/or handling and incur a 'ORM-D item' delivery service surcharge.

Restricted products can only be delivered within the 48 contiguous United States and Canada.

5-i. Proof of Delivery Requirements
Delivery service from iShopMarine.com usually requires a customer signature as 'proof of delivery'. Customers who desire that packages from iShopMarine.com be delivered without the signature requirement need to request an exemption. Customers should submit all requests for a 'proof of delivery' signature exemption via the 'Customer Support' link prominently displayed on the iShopMarine.com Web site clearly indicating the order number in the correspondence. The request must be received by iShopMarine.com prior to the day of shipment.

As a consequence of iShopMarine.com's ongoing fraud protection program, any customer order that indicates a 'ship to' address that is materially different from the 'bill to' address will require a 'proof of delivery' signature and may incurr an additional delivery service surcharge.

5-j. Delivery Service Refusal by Customer
Customer's refusal of delivery for a properly tendered order or part of an order from iShopMarine.com will be considered a 'Return' and processed according to the terms of iShopMarine.com's published 'Returns Policy'.

For delivery service refusal, all delivery service charges incurred will be the responsibility of the customer and significant re-stocking charges may apply.

5-k. Carrier 'Invalid Address' Returns
iShopMarine.com will apply its best efforts to notify the customer of an invalid delivery address and request an address correction. For corrected addresses, iShopMarine.com will attemp to re-deliver an order returned for an 'Invalid Address'. All d
elivery service charges for the returned shipment and the re-delivery will be charged to the customer.

Items returned by a delivery service carrier for 'Invalid Address' that cannot be successfully re-delivered, will be considered a 'Return' and processed according to the specified terms of iShopMarine.com's published 'Returns Policy'.

For 'Invalid Address' returns that cannot be successfully re-delivered, all delivery service charges incurred will be the responsibility of the customer and significant re-stocking charges may apply.

5-l. Carrier 'Invalid Address' Corrections
Some delivery service carriers automatically provide invalid or insufficient 'Ship-To' address correction service. Address correction surcharges incurred by iShopMarine.com due to an invalid or insufficient 'Ship-To' address provided by the customer, will result in a surcharge retroactively billed to the customer by iShopMarine.com.

5-m. Delivery Service Charges Billed to Customer's Account
iShopMarine.com offers customers the option of billing delivery service charges directly to their pre-existing account with a delivery service provider. To utilize this option, customers must provide a valid account number that is accepted by the designated delivery service provider.

While delivery service charges will be billed directly to the customer's account a nominal processing fee will be charged to cover the costs of order processing and packaging.

Customers who select direct billing of delivery service charges and don't provide a valid account number will be billed the normal shipping and handling charges associated with the processing and delivery of their order plus an additional 'invalid account' processing surcharge.

Customers providing an invalid account will not be notified of the change in delivery service charges prior to shipment.

6. Returns Policy
iShopMarine.com utilizes 'best efforts' to accurately represent products on our Web site. In the event that a 'Return' is required, the customer may elect to submit an item 'Change', 'Replacement' or 'Credit' request. Credit requests may be subject to re-stocking charges. Please review our detailed 'Returns Policy' for details. We are committed to the complete satisfaction of our customers.

All orders received from iShopMarine.com should be inspected by the customer upon arrival. 30 days subsequent to the date that the order was shipped by iShopMarine.com, all sales are final.

Return requests must be pre-approved and a 'Return Authorization' code must be obtained by the customer from iShopMarine.com's customer service department prior to a return shipment. 'Return Requests' may be submitted online. Returns not accompanied by a 'Return Authorization' number clearly indicated on the outside of the package will be refused. Please review our comprehensive 'Merchandise Return Policy' located prominently on the Web site.

Packages sent to iShopMarine.com without a 'Return Authorization' number clearly indicated on the outside of the package will be refused.

The customer is responsible for all return delivery service charges unless acknowledged to the contrary in writing by iShopMarine.com. In the event that iShopMarine.com agrees to accept return delivery service charges, reimbursement of charges is limited to the lowest published rate applicable for shipment by the designated delivery service provider utilizing a 'trackable' delivery service. Acceptable return delivery services are USPS Priority Mail, UPS or FedEx Ground services.

The 'Merchandise Return Policy' is an integral part of these 'Terms and Conditions of Sale'. Accepting these 'Terms and Conditions of Sale' implies that the customer has reviewed, understood and accepts the specified terms of the 'Merchandise Return Policy'.

6-a. Returns Tracking
All returns to iShopMarine.com should be made by 'trackable' delivery services such as UPS Ground, FedEx Ground or the U.S. Postal Service's Priority Mail. iShopMarine.com provides for the online recording by the customer of tracking information regarding returned items. Providing iShopMarine.com with tracking information for returned items may significantly facilitate the processing of returns.

The customer assumes all risks of non-delivery for authorized returns sent to iShopMarine.com by non-trackable delivery services.

It is not necessary for the customer to require a 'proof-of-delivery' signature for authorized returns to iShopMarine.com. We will accept the delivery service carrier's online tracking information indicating a successful delivery to iShopMarine.com.

Requiring a 'proof-of-delivery' signature for returns to iShopMarine.com may delay the processing of authorized returns and unnecessarily increases delivery service charges.

7. Order Cancellations
During normal work hours, order processing begins almost immediately upon the submission of an order. iShopMarine.com will in many cases incur shipping and handling charges from our suppliers when processing customer orders. Due to the charges incurred, all order cancellations may be subject to restocking charges of up to 20% of the value of the canceled merchandise.

7-a. Cancellation of Orders
Subsequent to the commencement of order processing, cancellations are at the discretion of iShopMarine.com and if granted, may incur restocking and/or processing charges.

7-b. Cancellation of 'Vintage Parts'
Any item described as a 'Vintage Part' is procured by iShopMarine.com in consideration of special restrictions from our suppliers. 'Vintage Parts' cannot be canceled subsequent to the commencement of order processing.

7-c. Cancellation of 'Shop Tools' or 'Service Aids'
iShopMarine.com makes available to customers a variety of Shop Tools and Service Aids to assist in the servicing of marine propulsion equipment and related activities. All Shop Tools and Service Aids, including service manuals, are provided by special order. Orders cannot be canceled subsequent to the commencement of order processing.

7-d. No Order Cancellations on or Subsequent to the Date of Shipment
Order or item cancellations are not accepted on or subsequent to the date of shipment. Orders or items canceled on or subsequent to the date of shipment are considered 'Returns' and are subject to iShopMarine.com's return requirements as specified in the 'Returns Policy' statement posted on iShopMarine.com's Web site.

Delivery service charges and significant re-stocking charges may apply to order or item cancellations requested on or subsequent to the date of shipment.

7-e. Order Cancelations Must be Acknowledged in Writing.
Customers should submit all requests for the cancelation of an order via the 'Customer Support' link prominently displayed on the iShopMarine.com Web site clearly indicating the order number in the correspondence. Email requests will also be considered. All accepted order cancellations are acknowledged by iShopMarine.com in writing usually by email. Verbal cancellations are non-binding.

8. Claims for Damages and/or Shortages
iShopMarine.com takes great care in filling, checking, and packing your order and makes every effort to ensure your full satisfaction. Please check all merchandise carefully upon arrival. If there are any damages or shortages call our customer service department. All claims must be recorded within seven days of receipt. This will permit us to file a claim with the carrier and/or reship the merchandise in a timely manner.

Keep damaged goods, containers, and packaging in their delivered condition for inspection by the carrier and/or iShopMarine.com until you are further advised. Credit will be issued after iShop Marine.com receives and inspects the returned merchandise. Approval of claims for damages and shortages are subject to approval at the sole discretion of iShop Marine.com.

It is important to have the delivering carrier's agent note the damage or shortage on all receipts and freight bills. If you accept a damaged or short shipment from the delivering carrier's agent without their proper notation, you do so at your own risk. Shippers are typically not responsible for merchandise damaged or lost by a delivery service carrier.

9. OSHA Hazardous Substance Product Information
Materials Safety Data Sheets (MSDS) are available on-line at iShopMarine.com for represented products that require an MSDS sheet.

10. Local Safety Standards and Regulations
Products sold by iShop Marine.com are designed to meet stated safety standards and regulations. Since local safety standards, codes and regulations vary significantly, iShop Marine.com cannot guarantee that products will meet all applicable requirements in each locality. Therefore, the customer assumes full responsibility for compliance with safety standards and regulations in the localities where the product will be shipped, sold and used.

iShopMarine.com is not responsible for how products are installed or used.

11. Customer Installation of Motor Parts Supplied by iShopMarine.com
All motor parts supplied by iShopMarine.com are intended for installation by qualified technical personnel. In some cases parts must be installed by 'Certified' factory technicians. Failure to use qualified technical personnel may result in the voiding of factory warrantees and any warrantees provided by iShopMarine.com.

12. Limited Warranty
iShopMarine.com provides a 'Limited 30 Day Warranty' that all productss supplied will be free of material defects. Additional warrantees may be available directly from product manufacturers. This warranty will be granted provided that the product is subject to normal usage and has been correctly installed and maintained by a qualified repair technician.

Product warrantees may be subject to the authorization and/or approval by the manufacturer of the product. As such, it is the responsibility of the customer to obtain authorization from the manufacturer for the return of products claimed to be defective. Depending on the policies of the manufacturer, products may be returned directly to the manufacturer or authorized by the manufacturer for replacement through iShopMarine.com. iShopMarine.com will only accept the warranty return of products if authorized in writing by the manufacturer.

All electrical and electronic products claimed to be defective must be certified by the manufacturer prior to the claim being accepted by iShopMarine.com.

Electrical and electronic products that are claimed to be defective are returnable for exact replacement only. No returns of electrical or electronic products will be credited to the customer.

Approval for the return or replacement of products claimed to be defective is at the sole discretion of iShopMarine.com.

This warranty does not apply to products that have been subject to misuse, abuse, neglect, improper installation, storage, handling or maintenance.

The customer's exclusive remedy for breach of this warranty is the replacement by iShopMarine.com of any defective merchandise returned to iShopMarine.com within the required thirty (30) day period. iShopMarine.com's total liability for all claims will not exceed the price paid for the products provided. In no event shall iShopMarine.com be liable for any incidental or consequential damages or for loss of profits or for any other damages not withstanding that iShopMarine.com may have been advised that such damage may be likely to occur.

THE FOREGOING IS iShopMarine.com's EXCLUSIVE WARRANTY AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PURPOSE. iShopMarine.com SHALL NOT BE LIABLE TO THE CUSTOMER ON ANY CLAIM OF NEGLIGENCE OR FOR ANY MANUFACTURER'S STRICT LIABILITY ON ANY MERCHANDISE. ALL INFORMATION PROVIDED BY ANY iShopMarine.com EMPLOYEE, AGENT, OR OTHER REPRESENTATIVE IS SUBJECT TO THIS LIMITED WARRANTY. NO ONE IS AUTHORIZED BY iShopMarine.com TO CHANGE THE FOREGOING PROVISIONS OR ASSUME ANY OBLIGATIONS OR LIABILITIES FOR iShopMarine.com.

13. Agreement
